Application by Wayne Fougere Architecture for Rezoning at 4620 & 4640 Smith Crescent from the “Small-Scale Multi-Unit Housing (RSM/XL)” Zone to “Town Housing (ZT107) – Smith Crescent (Hamilton)” ZonE

The Hamilton Area Plan envisions a minimum site area of 4,000.0 m2 (approximately 43,055 ft2). The subject site has a net site area of approximately 3,338 m2 (approximately 35,930 ft2)_ While this is less than the Area Plan Guidelines, staff support this rezoning application for the following reasons: • The applicant has submitted documentation ( copy on file) indicating efforts were made to acquire the properties to the north at 4600 Smith Crescent and 23380 Gates Avenue to initiate a larger assembly but was rejected by the neighbouring owners. • To support future redevelopment of the adjacent sites to the north, a Statutory Right-of- Way (SRW) permitting Public Right-of-Passage (PROP) will be secured over a portion of the development's internal drive aisle prior to final adoption of the rezoning bylaw. This will enable future access to the properties to the north should they redevelop. • The applicant has submitted a preliminary development concept plan to demonstrate how the properties to the north could be redeveloped, consistent with the OCP and Hamilton Area Plan. The Hamilton Area Plan includes objectives to improve non-motorized transportation options in the neighbourhood to better connect residents with parks and amenities. The proposed development will include the provision of new north-south and east-west pedestrian connections. Prior to final adoption of the rezoning bylaw, the application will provide a $235,336.05 contribution to the Hamilton Amenity Fund, consistent with the Hamilton Area Plan.
