POLICY & BY-LAW CONSIDERATIONS
Zoning By-law
•
The applicant proposes to rezone the subject site from "One-Acre Residential Zone (RA)" to
"Multiple Residential 30 Zone (RM-30)".
•
The proposed Rezoning By-law No. 20946 was granted Third Reading on November 20, 2023.
Setback Variance
•
The additional setback changes further support at-grade entrance design guidelines, the
connection and improved programming of amenity areas, and the improved livability of units.
The changes are minimal and will not alter the overall quality or design of the development,
nor is it anticipated that they will significantly impact surrounding properties.
•
The proposed setback variances include:
(a)
to reduce the minimum side yard on flanking lane setback (north) of the RM-30
Zone from 4.5 metres to 4.0 metres for Buildings 3 and 9;
(b)
to reduce the minimum side yard setback (south) of the RM-30 Zone from 6.0
metres to 3.0 metres to the indoor amenity building and the principal building face
for Buildings 4, 7 and 8 and 2.0 metres for Building 4 and 8 electrical closets; and
(c)
to reduce the minimum rear yard setback (west) of the RM-30 Zone from 6.0
metres to 4.20 metres for Unit 13 (Building 4).
•
The setbacks along the north, interfacing with the lane, are 4.5 metres to the front of units
and 4.0 metres to the side of unit (one unit only), to achieve an urban streetscape with
pedestrian access from a sidewalk. The existing townhouses to the north have sides of units
facing towards the lane. The proposed setback deviates 0.2 metres from the Council approved
Development Variance Permit No. 7922-0183-00.
•
The setbacks to the south will have side-of-units and the indoor amenity area on the subject
site interfacing with adjacent existing rear-of-unit townhouses to the south. This is a typical
setback reduction for this type of interface. The proposed setback deviates 0.1 metres from the
Council approved Development Variance Permit No. 7922-0183-00 and adds the 2.0 metre
setback for the electrical closets which were previously not captured in the original
Development Variance Permit.
•
The setbacks along the west, interfacing with the park, are 4.2 metres to the front of units.
The reduced setbacks (from 4.5 metres) allow for pedestrian access from the sidewalk and
enables the site to achieve greater entrances at grade.
•
Staff support the requested variances to proceed for consideration.
