Staff Report to Council Application No.: 7920-0099-00 Planning & Development Report Page 2 RECOMMENDATION SUMMARY • Council file Rezoning By-law No. 20608. • Council close Development Variance Permit No. 7920-0099-01. • Rezoning By-law to proceed to Public Notification. If supported, the By-law will be brought forward for First, Second and Third Reading. DEVIATION FROM PLANS, POLICIES OR REGULATIONS • To reduce the lot width and depth requirements of the Small Lot Residential Zone (R4). • To vary the garage/parking configuration of the Small Lot Residential Zone (R4). RATIONALE OF RECOMMENDATION • Prior to the Small-Scale Multi-Unit Housing (SSMUH) related Zoning Bylaw updates, Development Application No. 7920-0099-00 was introduced on March 28, 2022. The application proposed an amendment to the Sunnyside Heights Neighbourhood Concept Plan (NCP) from Low Density Residential (6-10 upa) to Medium Density Residential (10-15 upa) and for changes to the local road network, Rezoning from RA to RF-13 and a Development Variance Permit to the minimum lot widths and depths, parking configurations and driveway access, in order to facilitate the subdivision of two lots into 15. Council supported the application and a Preliminary Layout Approval (PLA) was issued on May 11, 2022. An amended Development Variance Permit introduced on September 11, 2023. • Due to the SSMUH Zoning By-law amendments adopted on July 8, 2024, the proposed bylaw and Development Variance Permit must be updated to reference the new zone as a housekeeping measure. There is no change to the previously supported 15 lot subdivision proposal. While most applications that require updates of this nature have been presented to Council in batches, the applicant has requested to proceed in advance of the next batch to avoid delaying final approval. • In accordance with changes to the Local Government Act, Section 464, under Bill 44 (2023) a Public Hearing is not required for the subject rezoning application as the proposed rezoning is consistent with the Official Community Plan (OCP). As such, Council is requested to endorse the Public Notification to proceed for the proposed Rezoning By-law. The Rezoning By-law will be presented to Council for consideration of First, Second, and Third Reading, after the required Public Notification is complete, with all comments received from the Public Notification presented to Council prior to consideration of the By-law readings.
