DEVIATION FROM PLANS, POLICIES OR REGULATIONS • Proposing a reduction in the side yard (east) setback of the IB-1 Zone from 3.6 metres to 0.0 metres, and a minor reduction in the street side yard (west) setback of the IB-1 Zone from 7.5 metres to 6.9 metres for a small portion of the building. RATIONALE OF RECOMMENDATION • The proposal complies with the Mixed Employment designation in the Official Community Plan (OCP). • The proposal complies with the Business Park, Business Park (Office) and Landscaping Strips designation in the Campbell Heights Local Area Plan (LAP). • There are two industrial buildings proposed. The proposed building setback reduction for both buildings along the east property line is consistent with other industrial sites where one of the setbacks adjacent to other industrial land can be reduced to 0.0 metres. The developed property to the east is also designated Mixed Employment in the Official Community Plan (OCP), and Business Park, Business Park (Office) and Landscaping Strips in the Campbell Heights Local Area Plan (LAP). • The proposed minor setback along 190 Street to the west is to accommodate a tapering road dedication to match the sidewalk with the site to the south. • On September 25, 2023, Council granted Third Reading to rezoning Bylaw No. 21028 to permit the development of a multi-tenant industrial building. On September 25, 2023 Council also authorized staff to draft the corresponding Development Variance Permit No. 7922-0080-00. This variance included one reduction of the east setback, and one reduction for the northern landscape buffer. The northern landscape buffer reduction is no longer required, so Development Variance Permit No. 7922-0080-00 is being closed, and replaced with the subject Development Variance Permit No. 7922-0080-01, for a reduction to the east and west building setbacks.
