•
Proposing to reduce the minimum setback distance for a Class A (red-coded) stream from 15
metres from top of bank to 10 metres from high water mark (in line with the streamside
protection and enhancement area [SPEA] setback) for the construction of a single family
home with secondary suite.
•
Seeking to reduce the front yard setback from 7.5 metres to 5.5 metres.
•
Seeking to reduce the rear yard setback from 7.5 metres to 4.3 metres.
•
Proposing to reduce the minimum lot depth from 30 metres to 8.5 metres.
•
Proposing to permit outdoor parking for the secondary suite within the front yard setback.
RATIONALE OF RECOMMENDATION
•
The proposal complies with the Urban designation in the Official Community Plan (OCP).
•
The proposed density and building form are appropriate for this part of Fleetwood.
•
The proposal complies with the Development Permit requirements in the OCP for Sensitive
Ecosystems (Streamside Areas and Green Infrastructure Areas).
•
Adherence to the City’s Part 7A streamside setback requirement will render the property as
undevelopable. The Ministry of Forests, Lands, Natural Resource Operations and Rural
Development accepted the Ecosystem Development Plan and agreed that SPEA will not be
affected by the proposed redevelopment of the site as long as the measures provided by the
QEP are adhered to.
•
The applicant’s Qualified Environmental Professional (QEP) has provided an Impact
Mitigation Plan as part of their Ecosystem Development Plan in support of the proposed
reduction to the streamside setback area. The applicant will be restoring the riparian area and
planting the streamside protection area with trees and shrubs. Additionally, the applicant is
proposing to convey approximately 701 square metres (37% of the site) to the City for
riparian/Green Infrastructure Network (GIN) area protection and entering into a restoration
agreement to ensure maximum safeguarding.
