Staff Report to Council Application No.: 7922-0221-00 & 7922-0222-00 Planning & Development Report Page 2 RECOMMENDATION SUMMARY • OCP Amendment & Rezoning Bylaws, and set date for Public Hearing. • Approval to draft updated General Development Permit for Form and Character, Sensitive Ecosystems, and Hazard Lands. • Approval for Development Variance Permit to proceed to Public Notification. DEVIATION FROM PLANS, POLICIES OR REGULATIONS • The applicant is proposing an amendment to the Official Community Plan (OCP) to allow a higher floor area ratio (FAR) within the Multiple Residential designation on proposed Lots 3 and 6. • The applicant is proposing to reduce the minimum Part 7A Streamside Protection setback for an existing Class A watercourse from 30.0 metres to a varied setback between 10.0 metres and 30.1 metres. RATIONALE OF RECOMMENDATION • Council granted Third Reading to the Rezoning bylaws and Official Community Plan (OCP) Amendment Bylaw associated with Development Applications No. 7922-0221-00 and 7922- 0222-00 on December 4, 2023. The applicant is coming forward at this time with a proposed Streamside Setback variance, which triggers changes to the Rezoning and OCP Amendment bylaws. In addition, the size of the active public park is proposed to be reduced, which also triggers changes to the site plan and rezoning and OCP amendment bylaws. • The applicant is proposing to reduce the minimum Part 7A Streamside Protection setback for an existing Class A watercourse from 30.0 metres to a varied setback between 10.0 metres and 30.1 metres. The applicant advises that the proposed new buildings will be further setback from the creek than the existing mobile home buildings, providing a net increase in the riparian setback area. The applicant also notes that they will be enhancing the riparian area that is currently encumbered by existing mobile home buildings. The proposed streamside setback is outside of the Provincial Riparian Areas Protection Regulation (RAPR) setback. • As a result of the proposed changes to the project, the applicant is proposing a slight increase in the maximum Floor Area Ratio (FAR) for proposed Lot 6 from what was proposed previously for Lot 6, from 2.48 FAR to 2.49 FAR. The applicant is proposing a decrease in the maximum Floor Area Ratio (FAR) for proposed Lot 3 from what was proposed previously for Lot 3, from 2.45 FAR to 2.23 FAR. This necessitates an OCP Amendment to allow a higher floor area ratio (FAR) within the Multiple Residential designation for proposed Lots 3 and 6.
