A Class A watercourse (Cummins Creek) is located to the east of the subject property. The
northern portion of the watercourse is considered a constructed channelized watercourse
which requires a 25-metre setback from the top-of-bank and the southern portion is
considered a natural channelized watercourse which requires a 30-metre setback from the
top-of-bank (see Appendix IV.).
•
A yellow coded wetland is adjacent to the east of the channelized watercourse which requires
a 15-metre setback and falls entirely within the 30-metre setback of the natural channelized
watercourse.
•
The applicant proposes a planting plan and maintenance schedule to enhance the
environmental area and remove some historical retaining walls within the setback area. The
applicant will protect the area on the site through the registration of a combined Restrictive
Covenant/Right-of-Way against the property to ensure safeguarding and maintenance of the
Protection Area in perpetuity, in compliance with the OCP.
